Landlords need to ensure that their properties are maintained properly and should ensure proper dilapidations practice by warning tenants in advance of neglect. This is done either during or towards the end of a lease by establishing the condition of a property and assessing whether the tenant has observed repairing and other covenants that were mentioned in the lease.
A Schedule of Dilapidations will be prepared by us and sent to the tenants, listing all necessary works required to the building to comply with the terms of the lease.
Most tenants are unaware that under the terms of their lease, they are often responsible for repairs, maintenance and even replacing parts of the building, fixtures or fittings even the property was in a relatively poor condition when the tenant first took on the lease. It is not unusual for agreements to require the tenant to put the property into a better condition during the course of the lease than it was at the beginning.
In order to protect the tenant’s interests, it is generally advisable to have Seths prepare a Schedule of Condition prepared prior to taking on a lease. We will record the condition of the building at the beginning of the lease and provide a schedule of photographs.
